Project Files Available for Downloading - SV2 Santa Clara IBX Center

For our client's benefit FENNIE+MEHL Architects ("ARCHITECT") from time to time will make selected computer files available for downloading. Please note that all of ARCHITECT'S files are instruments of service and are protected by a copyright held by ARCHITECT. Prior to downloading any files read the following Agreement and only download the files if you agree with all of the provisions stated herein.

Waiver of Liability and Indemnification Agreement

The RECIPIENT recognizes that during the course of the project, changes and modifications to these instruments of service will occur as the project develops. The RECIPIENT also recognizes that changes to computer documents are easy to do, difficult to detect, and that conversion, or the use of the data by others may introduce anomalies, errors or inexactness that may result in adverse consequences that the ARCHITECT can neither predict nor control. The RECIPIENT thus agrees to assume all risks associated with the use of the information provided in ARCHITECT'S files, and understands that the ARCHITECT makes no claim nor warranty as to the suitability of ARCHITECT'S files for any purpose.

In consideration for receiving ARCHITECT'S files, in machine-readable form, the RECIPIENT agrees, to the fullest extent permitted by law, to waive any claim against ARCHITECT and to defend, hold harmless and indemnify the ARCHITECT from and against all claims, liabilities, losses, damages, and costs, including but not limited to attorney's fees and expert's fees, arising out of, or in any way connected with, the use, re-use, mis-use, modification, or misinterpretation of the machine-readable information provided by the ARCHITECT under this Agreement.

Please use the attached files only if you have agreed to abide by the above terms and conditions of this AGREEMENT. By downloading these files, you indicate acceptance of this AGREEMENT.
